Abstract

Section 106 is information taken from the S106 legal agreement showing the contributions that have been paid where there is still unspent money available,
this shows the development location, planning reference, refund date and money remaining.

A S106 Agreement is entered into to make the Planning Permission acceptable in planning terms, the obligations within the agreement include payment of
contributions towards highways, travel planning etc or could be works to be carried out via a S278/S38 e.g. junction improvement, at the developers own cost.

Once the relevant triggers have been met as per the agreement e.g. on Commencement or Occupation of the first dwelling, a Demand Notice is sent to the developer
requesting payment including any indexation due, when received This information is recorded in DEF MasterGov system and on the Traffic Light Report (TLR).
This data shows amount remaining of any contributions received and the Refund status – Red, Amber, Green, No colour:
Red = less than 3 years remain before refund date
Amber - 3-5 years remain before refund date
Green = no refund date OR more than 5 years remain
No colour = exceeded refund date

Once expenditure has occurred then DEF MasterGov and the TLR are updated accordingly and when all available monies have been spent they are removed from the TLR.
The coordinates are taken from the planning application forms, Local Planning Authority Websites, CDP Smart or using UK Grid Reference Finder
